1. Introduction

These Terms & Conditions govern your use of the Stradbroke Island Tours website (stradbrokeislandtours.com) and the booking of our tour services. Stradbroke Island Tours (ABN 69 168 032 577) is operated by Hernandez Corporation PTY LTD. By using this website or making a booking with us, you agree to these terms.

2. Booking Terms

  • All bookings are processed through Rezdy, our third-party booking platform. Rezdy handles payment processing; Stradbroke Island Tours does not collect or store credit card details.
  • Your booking is confirmed once payment is successfully processed and you have received a confirmation email.
  • All bookings are subject to availability.
  • Bookings must be made by a person aged 18 or over. Participants under 18 are welcome on the tour when accompanied by a parent or guardian.
  • Minimum group sizes may apply. If the minimum is not met for a departure, you will be offered a full refund or the option to reschedule to another date.

3. Pricing

  • All prices are quoted in Australian Dollars (AUD) and include GST.
  • Prices may change without notice, but any confirmed bookings will be honoured at the price paid at the time of booking.
  • Any additional fees will be disclosed at the time of booking.

4. Cancellation & Refund Policy

We understand that plans can change. We aim to be fair and transparent about our cancellation and refund process.

Cancellation by the customer

  • 48 or more hours before departure: full refund.
  • Less than 24 hours before departure, or a no-show: no refund.

All cancellation and refund requests must be submitted in writing to info@stradbrokeislandtours.com.

Changes by the customer

You may request to reschedule your tour up to 24 hours before the tour start time, subject to availability.

Cancellation by Stradbroke Island Tours

In the rare case that we must cancel a tour due to severe weather, operational issues, or because minimum numbers are not met, you will be offered a choice between an alternative date or a full refund.

Approved refunds are processed to the original payment method within 5–10 business days.

Your rights under Australian Consumer Law

This cancellation policy does not exclude or limit your rights under the Australian Consumer Law. If our services do not meet the consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), you are entitled to a remedy, which may include a refund or compensation.

5. Weather & Safety

  • Our tours operate in natural outdoor environments and may be affected by weather, sea conditions, or other factors outside our control.
  • We reserve the right to modify itineraries, shorten tours, or cancel departures where this is necessary for guest and staff safety.
  • Where we cancel a tour entirely, the operator-cancellation provisions in Section 4 apply.
  • We recommend that you check weather forecasts before your tour and dress appropriately.

6. Participant Requirements

  • Our tours involve moderate physical activity, including walking on uneven terrain and beach environments.
  • Participants must follow all instructions given by our guides for safety and for the protection of the environment.
  • Please disclose any relevant medical conditions or mobility considerations when booking so we can plan appropriately. See our Accessibility page for more detail.
  • We reserve the right to refuse participation where we reasonably believe it poses a safety risk. A full refund will be provided in this case.
  • Appropriate footwear, sun protection, and adequate drinking water are recommended on every tour.

7. Liability & Risk Acknowledgement

  • Nature-based eco-tourism activities carry inherent risks, including but not limited to uneven terrain, wildlife encounters, sun exposure, water-related activities, and changing weather.
  • To the maximum extent permitted by law, our liability is limited to the price you paid for your tour.
  • Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence — this exclusion is not permitted under Australian law.
  • Consumer guarantees under the Australian Consumer Law are acknowledged and are not excluded by these terms.
  • We strongly recommend that all participants hold appropriate travel insurance.

8. Photography & Content

  • Our guides may take photographs and video footage during tours for use in our marketing and on social media.
  • If you would prefer not to appear in any marketing material, please let your guide know on the day of the tour.
  • Photographs, reviews, or other content that you voluntarily submit to us (including tagged social media posts) may be used by Stradbroke Island Tours for marketing purposes.

9. Intellectual Property

All content on this website — including text, photography, video, branding, and design — is owned by Stradbroke Island Tours or used under licence. Content may not be reproduced, redistributed, or used commercially without our prior written permission.

10. Third-Party Links & Services

  • Our website may contain links to third-party websites, including Rezdy (booking), social media platforms, and partner organisations.
  • We are not responsible for the content or practices of those third-party sites.
  • Bookings made through Rezdy are also subject to Rezdy's own terms and privacy policy.

11. Governing Law

  • These terms are governed by the laws of Queensland, Australia.
  • Any dispute arising out of or in connection with these terms is subject to the exclusive jurisdiction of the courts of Queensland.
  • Nothing in these terms is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth) or other applicable consumer protection laws.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. The “Last updated” date at the top of this page reflects the most recent change. Continued use of the website or of our services after changes are posted constitutes your acceptance of the updated terms.
